In addition to the form of paper labor contracts, from July 1, 2026, according to Decree 337/2025/ND-CP dated December 24, 2025, businesses in Vietnam have a new option of signing electronic labor contracts.
WHAT IS ELECTRONIC LABOR CONTRACT?
Decree No. 337 provides general regulations on the conclusion and implementation of electronic labor contracts, development, updating, management, maintenance, exploitation and use of electronic labor contract platforms:
- Electronic labor contracts have the same legal validity as paper contracts. At the same time, all electronic labor contracts are attached to a unique ID and stored on a national platform managed by the Ministry of Home Affairs.
- This option helps to save printing paper costs, save storage space, improve the efficiency of searching, lookup, and record management, and reduce the risk of loss, eliminate geographical barriers, can manage contracts uniformly from the headquarters, allow the conclusion of contracts, etc amend and terminate contracts quickly, remedy errors more easily and faster than paper records.
- Electronic labor contracts can be integrated with human resource management and accounting software, management from recruitment, signing, payroll, social insurance, and automatic reporting of labor use according to regulations.
- In addition to procedures and human resources who are proficient in digital transformation, enterprises will have to invest in additional costs for digital signatures, timestamp services, electronic labor contract services, costs from upgrading information technology infrastructure, security software, etc converting existing valid paper labor contracts into electronic contracts, integrating internal systems, etc.
- Although e-labor contract service providers have a responsibility for security, the risk of cyber attacks and data leaks still exists. When all personnel information is stored and processed in the digital environment, enterprises are responsible for storing and maintaining personal data in accordance with the law, reporting as soon as security risks, falsification or unauthorized access are detected.
WHEN AND HOW SHOULD ENTERPRISE IMPLEMENT ELECTRONIC LABOR CONTRACT?

E-labor contracting is not currently mandatory but an option for businesses to consider, especially when there are needs to digitize labor relations management, and it is necessary to be prepared to be ready in the next 2 or 5 years.

Wait for the e-labor contract service market to be more stable in terms of both detailed guidelines from state agencies and practical application.
- During the transition period, enterprises can apply both electronic and paper labor contracts in parallel.
